Personal data

The Roskomnadzor Office for the Irkutsk Region informs:

In accordance with paragraph 1 of Article 22 of Federal Law No. 152-FZ of July 27, 2006, "On Personal Data" (hereinafter referred to as the Federal Law "On Personal Data"), state and municipal bodies, legal entities, or individuals organizing and/or processing personal data in the Irkutsk Region (hereinafter referred to as "Operators") must submit a Notification of Intent to Process Personal Data to the Roskomnadzor Office for the Irkutsk Region (hereinafter referred to as "Office") for registration in the register of operators processing personal data, with the exception of cases provided for in Part 2 of Article 22 of the Federal Law "On Personal Data."
In accordance with the Federal Law "On Amendments to the Federal Law "On Personal Data," Certain Legislative Acts of the Russian Federation, and the Repeal of Part Fourteen of Article 30 of the Federal Law "On Banks and Banking Activities" No. 266-FZ dated July 14, 2022, a new version of Article 22 of the Federal Law "On Personal Data" entered into force on September 1, 2022. This new version requires Operators to submit a Notice of Intent to Process Personal Data to the Administration. In most cases, Operators operating in the Irkutsk Region fail to comply with the notification requirements to the Administration or fail to provide information about changes, which results in violation of the above-mentioned legal requirements in the field of personal data. 
We would also like to inform you that Order No. 180 of the Federal Service for Supervision of Communications, Information Technology, and Mass Media dated October 28, 2022, "On Approval of Forms for Notifications of Intent to Process Personal Data, on Changes to Information Contained in a Notification of Intent to Process Personal Data, and on Termination of Personal Data Processing" has amended the Notification forms. Notification forms are available on the Personal Data Portal at https://pd.rkn.gov.ru/.
Furthermore, we would like to clarify that failure to submit or late submission to a government agency of information required by law and necessary for that agency to carry out its legitimate activities, as well as submission of such information to a government agency incomplete or distorted form, will result in administrative liability in accordance with Article 19.7 of the Code of the Russian Federation on Administrative Offenses.
